3. Maximum Liability Cap

In no event shall Dovecon Ab Oy's total liability to you for all damages, losses, and causes of action exceed the amount paid by you to us during the twelve months preceding the event giving rise to liability, or one hundred British Pounds (£100), whichever is greater.

4. Exceptions to Limitations

Nothing in these Terms and Conditions shall exclude or limit our liability for:

6. Force Majeure

Dovecon Ab Oy shall not be liable for any failure or delay in performance resulting from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, wars, terrorism, riots, embargoes, acts of civil or military authorities, fires, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.

2. Jurisdiction and Venue

Any disputes arising out of or relating to these Terms and Conditions or our services shall be subject to the exclusive jurisdiction of the courts of England and Wales. You irrevocably consent to the jurisdiction of such courts and waive any objection to proceedings in such courts on the grounds of venue or on the grounds that proceedings have been brought in an inconvenient forum.

3. Dispute Resolution Process

Prior to initiating any formal legal proceedings, the parties agree to attempt to resolve disputes through the following process:

• 1. Informal Negotiation: Contact us in writing to describe the issue and seek resolution
• 2. Good Faith Discussions: Both parties will engage in good faith discussions to resolve the matter
• 3. Escalation Period: Allow 30 days for informal resolution attempts
• 4. Formal Proceedings: If unresolved, either party may pursue formal legal remedies

4. Severability

If any provision of these Terms and Conditions is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable while maintaining its original intent. If modification is not possible, the provision shall be severed, and the remaining provisions shall continue in full force and effect.

5. Waiver

No waiver by Dovecon Ab Oy of any term or condition set forth in these Terms and Conditions shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any failure by Dovecon Ab Oy to assert a right or provision under these Terms and Conditions shall not constitute a waiver of such right or provision.

6. Assignment and Transfer

You may not assign, transfer, or delegate any of your rights or obligations under these Terms and Conditions without our prior written consent. Any attempted assignment in violation of this provision shall be null and void. Dovecon Ab Oy may freely assign or transfer these Terms and Conditions without restriction.

7. Entire Agreement

These Terms and Conditions, together with our Privacy Policy, Cookie Policy, and any specific project agreements, constitute the entire agreement between you and Dovecon Ab Oy regarding the subject matter herein and supersede all prior or contemporaneous understandings and agreements, whether written or oral.

8. Relationship of the Parties

Nothing in these Terms and Conditions shall be construed to create a partnership, joint venture, employment, or agency relationship between you and Dovecon Ab Oy. Neither party has the authority to bind the other or to incur obligations on the other's behalf without prior written consent.

9. Survival

All provisions of these Terms and Conditions which by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification obligations, and limitations of liability.

10. Modification of Terms

Dovecon Ab Oy reserves the right to modify these Terms and Conditions at any time. We will notify users of material changes by updating the "Last updated" date and, where appropriate, by posting a notice on our website or sending email notification. Your continued use of our services following such modifications constitutes your acceptance of the revised Terms and Conditions.
